Guest lecture: Seminar asylrechtliche Entscheidungen.In SA v Staatssecretaris (C-151/22) hat der EuGH im November 2023 entschieden, dass es bei der Auslegung des Fluchtgrunds 'politische Meinung' nicht darauf ankommt, dass es sich um eine identitaetsstiftende Ueberzeugung von besonderer Tiefe handelt. Fuer die Frage der Begruendetheit der Furcht vor Verfolgung muss das Mass der Ueberzeugung hingegen durchaus beruecksichtigt werden. Damit setzt das Urteil die umstrittene Rechstsprechung fort, die The Concealment Controversy (CUP 2021) adressiert.
[In SA v Staatssecretaris (C-151/22), the CJEU ruled in November 2023 that the interpretation of ‘political opinion’ as a reason for persecution does not depend on whether it is a fundamental conviction that is identity defining for the applicant. For the question of the wellfoundedness of the fear of persecution, however, the strength of the conviction must be taken into account. The judgement thus continues the controversial case law that is discussed in the monograph The Concealment Controversy (CUP 2021).]
