Description
Abstract: This thesis provides an overview of the right to free movement within the country under international and European human rights law, as well as under Spanish and German domestic legal systems. It focuses specifically on asylum-seekers, given the severe restrictions on movement and residence that this category of migrants is subjected to in several European States. The analysis is carried out from four different angles, each of which corresponds to one of the chapters of the thesis: (1) the examination of the travaux préparatoires of the various instruments that enshrine this freedom, (2) the personal scope of the right according to legal doctrine and case law, (3) the safeguards offered by this right, and (4) the spatial boundaries of the right, i.e. the distinction between a restriction on movement and a deprivation of liberty. The last two chapters also consider whether the law protects the freedom of movement of asylum-seekers to a lesser extent than that of nationals and individuals in general.
