Curriculum vitae

Vivian Bij de Vaate is universitair hoofddocent arbeidsrecht aan de Vrije Universiteit. Sinds 2023 is zij tevens opleidingsdirecteur van de Master Rechtsgeleerdheid. Daarnaast is zij raadsheer plaatsvervanger bij het Gerechtshof Amsterdam, redactielid van het tijdschrift Arbeidsrechtelijke Annotaties en het tijdschrift voor ontslagrecht alsmede lid van de werkgroep ontslagrecht van de Vereniging voor Arbeidsrecht.   

Vivian ronde in 2011 haar studie rechtsgeleerdheid cum laude af met een specialisatie in het arbeidsrecht, waarna zij direct aansluitend in dienst trad als docent/onderzoeker bij de vaksectie Sociaal recht aan de Vrije Universiteit. In 2015 verdedigde zij haar proefschrift met de titel ‘Bijzonder ontslagprocesrecht’. In 2013-2014 werkte zij naast haar aanstelling als docent/onderzoeker bij de VU een dag per week als paralegal bij de Brauw Blackstone Westbroek. Van 2015 tot 2023 was zij voor een dag per week verbonden aan Baker Mckenzie als professional support lawyer. Van 2019 tot 2023 was Vivian secretaris en vice voorzitter van de facultaire examencommissie van de VU. 

Vivian Bij de Vaate is an associate professor of labour law at the Vrije Universiteit Amsterdam. Since 2023, she has been programme director of the Master of Laws. She is also a deputy judge at the Amsterdam Court of Appeal, a member of the editorial board of the journal Arbeidsrechtelijke Annotaties and the journal for dismissal law (Tijdschrift voor ontslagrecht), and a member of the Dismissal law working group of the Employment Law Association (Vereniging voor Arbeidsrecht). 

Vivian graduated in 2011 (cum laude) at the Vrije Universiteit. In 2015 she defended her PhD dissertation at the Vrije Universiteit on Dutch procedural dismissal law. During her appointment at the Vrije Universiteit, Vivian also participated in several ancillary activities. Next to her PhD trajectory, Vivian was a paralegal at the Brauw Blackstone Westbroek for one day a week in 2013-2014. Thereafter, she started working as professional support lawyer at Baker Mckenzie Amsterdam for one day a week until 2023.  From 2019 to 2023, she was secretary and vice chair of the Examination Board of the VU Law Faculty.

Research

In haar onderzoek richt Vivian zich met name op het ontslagrecht en de rechtsbescherming en handhaving van het arbeidsrecht onder andere door het (arbeids)procesrecht. Zij publiceert daarover regelmatig in nationale en internationale wetenschappelijke tijdschriften en boeken. Tussen 2011 en 2014 schreef zij een proefschrift getiteld ‘Bijzonder ontslagprocesrecht’ dat in kaart brengt op welke punten het ontslagprocesrecht afwijkt van het ‘normale’ civiele- en bestuursprocesrecht, wat de achterliggende redenen daarvoor zijn en of deze afwijkingen geoorloofd zijn, onder meer in het licht van rechtsbescherming en hogere normen als art. 6 EVRM. Daarnaast is rechtsvergelijkend onderzoek gedaan naar het Duitse en Italiaanse ontslagprocesrecht. Promotores: prof. W.H.A.C.M. Bouwens en prof. W.L. Roozendaal.

Vivian’s main research interests are dismissal law and the legal protection and enforcement of employment law, including employment litigation. She publishes regularly on this topic in national and international journals and books. Between 2011 and 2014 she worked on her doctoral research on the differences between dismissal proceedings and ‘ordinary’ civil and administrative proceedings, the underlying reasons for these differences and whether they are justified in light of judicial protection and higher standards as Article 6 ECHR. In addition, she conducted comparative law research with the German and Italian dismissal rules. Her dissertation was supervised by Prof. W.H.A.C.M. Bouwens and Prof. W.L. Roozendaal.

Teaching

Vivian Bij de Vaate is betrokken in onderwijsactiviteiten van zowel de Bachelor als de Master Rechtsgeleerdheid waaronder het vak Sociaal recht (bachelor), Verdieping arbeidsrecht (master) en Onderneming en Arbeid (master). Ook begeleidt zij zowel bachelor als masterscripties. Daarnaast is zij onderwijscoördinator van de afstudeerrichting arbeidsrecht.

Vivian Bij de Vaate is a coordinator and lecturer of various courses at the LL.B and LL.M level, including Sociaal recht (Social Law; bachelor), Verdieping arbeidsrecht (Advanced course labour law; master) en Onderneming en Arbeid (Undertakings and labour course; master). In addition, Vivian supervises bachelor’s and master’s theses. She is coordinator of the master track arbeidsrecht (labour law).

Nominations, grants and awards

In 2013 ontving Vivian de Levenbach-prijs voor de beste publicatie op het gebied van het arbeidsrecht en socialezekerheidsrecht met haar publicatie ‘De ontbindingsprocedure: rechtsmiddelenverbod en bewijsrecht’, ArA 2013/3.

In 2015 ontving zij een subsidie van het Gezina van der Molenfonds. Dat fonds van de Vrije Universiteit kent subsidies toe aan getalenteerde vrouwelijke wetenschappers om hun carrière te stimuleren.

In 2017 werd het proefschrift van Vivian genomineerd voor de proefschriftprijs 2012-2016 voor de beste proefschriften op het gebied van het arbeidsrecht en socialezekerheidsrecht. Zij eindigde op de shortlist van vijf proefschriften.

In 2020 verwierf zij facultaire subsidie voor een promotieonderzoeksproject naar collectieve handhaving van het arbeidsrecht door de vakbonden, gefinancierd door het Nationale Sectorplan Rechten.

In 2013, Vivian received the Levenbach award for the best article in the field of labour law and social security law.

In 2015, she received a Gezina van der Molenfonds grant. The Gezina van der Molenfonds of the Vrije Universiteit offers grants to talented female researchers to stimulate their career.

In 2017, her PhD dissertation was nominated for the dissertation award (2012-2016) in labour law and social security law (shortlist of five dissertations).

In 2020, she obtained a faculty grant for a PhD research-project about the collective enforcement of labour law by trade unions funded by the National Sector Plan Law.
