Abstract

Governments continue to remove migrants from their territory without it resulting in a violation of the Convention in the vast majority of the cases (of collective expulsion an expulsion of aliens) assessed by the ECtHR. How do governments attempt to shape the rights expressly designed to protect migrants from being expelled – to continue deciding who enters and stays in their territory?
