Abstract

In this book, four experts from Belgium, Germany, France, and the Netherlands compare the roles of litigants, lawyers, and judges in the fact-finding process in civil proceedings in their legal culture.

Judge Cindy Seinen (the Netherlands), Prof. Christian Gomille (Germany), Prof. Wannes Vandenbussche (Belgium) and Prof. Frédéric Rouvière (France) report on how fact-finding is managed in civil procedures in their countries, and on how behaviours that hinder fact-finding are sanctioned.
