Abstract

This entry provides an overview of the key elements of intellectual property law in the Netherlands, focusing on: Historical hints, main sources of national law, international and constitutional frame; Trademarks, trade names and other distinctive signs; Geographical indications and origin denominations; Copyright and neighbouring rights; Patents; Design protection; Software, databases and semiconductor topographies; Technical and business knowhow; New plant varieties; Enforcement of IPRs; and Customs surveillance and criminal law.
The law is correct at the time of writing, 1 March 2024. The section on Trademarks, trade names and other distinctive signs was co-authored by Lotte Anemaet and Stef van Gompel.
